Section 504 Services

Overview:
Section 504 of the Rehabilitation Act of 1973 is a federal law designed to protect the rights of individuals with disabilities in programs and activities that receive federal financial assistance. Tuloso-Midway ISD is committed to providing a free, appropriate public education (FAPE) to each qualified student with a disability.


What is Section 504?

Section 504 is a civil rights law that prohibits discrimination against individuals with disabilities. Under Section 504, eligible students are entitled to accommodations, modifications, and services to ensure equal access to education.


Eligibility

A student may qualify for Section 504 services if they have a mental or physical impairment that substantially limits one or more major life activities, such as:

  • Learning
  • Reading
  • Concentrating
  • Communicating
  • Walking
  • Breathing
  • Performing manual tasks
     

Eligibility is determined through an evaluation process that considers information from various sources, including parents, teachers, and medical providers.


Referral Process

If you believe your child may qualify for services under Section 504, you can initiate the referral process by contacting your child’s campus counselor or principal. Referrals can be made by parents, teachers, or other school personnel.


Evaluation Process

The evaluation process involves:

  1. Collecting relevant information from parents, teachers, medical providers, and other sources.
     
  2. Determining eligibility through a 504 committee.
     
  3. Develop an individualized 504 Plan if the student is eligible

504 Plan Development

A 504 Plan outlines the specific accommodations and services your child needs to access the general education curriculum. This plan is reviewed and updated annually to meet your child’s needs.


Parent Rights

Parents have specific rights under Section 504, including the right to:

  • Receive notification of meetings, evaluations, and decisions.
  • Review relevant educational records.
  • Request changes to the 504 Plan.
  • File a grievance if they believe their child's rights have been violated.
